Terms of Service, Pledges and GDPR

Introduction

Aenead (“Aenead”, “we”, “us” or “our”) provides services, features, and functionality (collectively, the “Services”) to you subject to these Terms of Service (the “Terms”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

Services, Fees, and Availability

Some Services are provided free of charge, while others require payment. Pricing, billing terms, and payment requirements, where applicable, will be disclosed to you prior to use. Unless otherwise stated, all fees are non-refundable.

Aenead reserves the right to modify, introduce, suspend, or discontinue any Services, including free or paid offerings, at any time and without prior notice. Failure to pay applicable fees may result in suspension or termination of access to paid Services.

Acceptable Use

You may not resell, sublicense, lease, distribute, or otherwise commercialise the Services, whether free or paid, unless explicitly authorised in writing by Aenead.

You agree not to use the Services for any unlawful, fraudulent, harmful, abusive, or otherwise nefarious purpose, or in any manner that violates applicable laws, regulations, or the rights of third parties.

User Responsibility

You are solely responsible for your use of the Services and for all activity conducted through your account. You are responsible for maintaining the confidentiality and security of your account credentials and for any actions taken using your account.

Aenead does not endorse, control, or assume responsibility for user conduct and shall not be liable for any loss, damage, or harm arising from your use or misuse of the Services or from interactions with other users.

Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Aenead shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of, or inability to use, the Services, even if advised of the possibility of such damages.

Suspension and Termination

Aenead reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate your access to the Services for any reason, including but not limited to violation of these Terms, suspected misuse, non-payment, or operational, legal, or security concerns.

Changes to These Terms

Aenead may revise these Terms from time to time. Continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms.

Data Integrity and Processing

Aenead processes and stores user data on infrastructure hosted primarily in the United States, including facilities located in Western North Carolina and Washington, DC.

Network traffic to and from Aenead’s servers may, at times, be routed through third-party content delivery networks or security providers, including but not limited to Cloudflare, for purposes such as performance optimisation, reliability, and protection against abuse. Such routing may vary based on network conditions and is not guaranteed for all traffic.

In the course of providing the Services, user data may be transmitted to, stored by, or otherwise processed by third-party service providers acting on Aenead’s behalf, including hosting, storage, analytics, or operational support providers. These providers are authorised to process user data only as necessary to perform services for Aenead and in accordance with applicable contractual and confidentiality obligations.

Where the General Data Protection Regulation (EU) 2016/679 (“GDPR”) applies by law, Aenead implements appropriate safeguards for cross-border data transfers as required. For users outside jurisdictions where such laws apply, any equivalent protections are provided voluntarily and do not constitute an acknowledgment of legal applicability.

GDPR Rights

Where the GDPR applies by law, Aenead complies with all applicable requirements.

In addition, Aenead may, at its discretion, honour certain data protection rights commonly associated with the GDPR—such as rights of access, rectification, erasure, or restriction of processing—for users who are not located in the European Union. Any such accommodation is provided voluntarily as a matter of policy and does not constitute an acknowledgment that the GDPR or any other data protection law applies to Aenead, the Services, or such users.

Aenead reserves the right to limit, modify, or decline GDPR-equivalent requests where compliance is not legally required, is technically infeasible, would impair the rights of others, or would impose a disproportionate burden.

Privacy

Aenead collects information provided directly by users in connection with their use of the Services, which may include, but is not limited to, name, email address, date of birth, and other information voluntarily submitted by the user.

In addition, Aenead automatically collects certain technical and connection-related information necessary to operate, maintain, and secure the Services. This may include IP address, device identifiers, browser or client information, timestamps, and related metadata. Such information may be logged and retained for operational, security, diagnostic, or compliance purposes.

Certain Services, including but not limited to Cloud and Email services, do not store user data in encrypted form at rest. As a result, Aenead may have technical access to such data. Aenead does not access user content except where reasonably necessary to operate the Services, respond to user requests, address technical issues, comply with legal obligations, or protect the security and integrity of the platform. Where practicable and not prohibited by law or security considerations, users will be notified of such access via Matrix, email, or other appropriate communication channels.

Service Rules

Service rules apply wherever users may interact with others through the Services, including but not limited to Matrix.

  • Content that is illegal under United States law is prohibited.
  • Crude content, including sexual or other NSFW material, must be clearly marked as sensitive where technically supported.
  • Advertisements, spam, or other unsolicited solicitations are prohibited unless explicitly authorised.
  • Content or conduct that promotes or supports severe harm or abuse is prohibited. This includes, but is not limited to, advocacy or endorsement of genocide, pedophilia, or slavery.

Aenead reserves the right to interpret and enforce these rules at its sole discretion in the interest of user safety, platform integrity, and legal compliance.
